Terms of Service

These Terms govern access to LunarWise, subscriptions, intellectual-property rights, acceptable use, optional health document uploads, and the limits of the product’s forecasts, reports, and AI features.

  • LunarWise is for informational use only, including lab-related outputs, and is not a medical device.
  • Users must be at least 18 and responsible for the accuracy of what they log.
  • Optional lab report uploads support organization, pattern review, and doctor-prep conversations only.
  • Subscriptions renew under the terms of Apple, Google, or other authorized payment providers.
  • We may suspend accounts for misuse, fraud, or abuse of the service.

1. ACCEPTANCE OF THESE TERMS

These Terms of Service (“Terms”) form a binding agreement between you and LunarWise, LLC (“LunarWise,” “we,” “our,” or “us”) regarding your access to and use of the LunarWise mobile application, websites, content, reports, tools, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms and to the LunarWise Privacy Policy. If you do not agree, do not use the Services.

2. ELIGIBILITY

You must be at least 18 years old to create an account or use the Services. By using LunarWise, you represent that you meet this eligibility requirement and that you can enter into a binding agreement.

3. THE NATURE OF THE SERVICES

LunarWise is a journaling, forecasting, pattern-tracking, and informational support product designed to help users organize cycle, symptom, mood, wellness, and related reproductive-health information.

The Services may include:

  • cycle and timing forecasts;
  • symptom and mood tracking;
  • AI-assisted reflections and summaries;
  • pattern and cluster analysis;
  • visit-prep and report-style summaries;
  • optional lab report or health document uploads that allow LunarWise to extract structured information for pattern support; and
  • educational or advocacy-oriented guidance.

LunarWise may allow users to upload lab reports or similar health documents so the app can extract structured information and compare it with tracked symptoms, cycle patterns, lifestyle data, medications, and generated reports. These features are intended for organization, pattern support, and healthcare conversation preparation only.

LunarWise is not a medical device. LunarWise does not provide medical care, diagnosis, treatment, or emergency services.

4. NO MEDICAL ADVICE

All outputs generated by LunarWise, including forecasts, summaries, reports, AI chat responses, pattern observations, and coaching-style content, are provided for informational and educational purposes only.

Lab-related outputs, extracted values, reference-range notes, correlations, and generated reports are informational only. LunarWise does not provide medical diagnoses, treatment recommendations, prescriptions, or clinical interpretation. Any lab-related output should be treated as informational and discussed with a qualified healthcare provider.

You understand and agree that:

  • LunarWise does not replace a licensed physician, therapist, pharmacist, or other qualified clinician;
  • no output from the Services should be treated as medical advice, diagnosis, or treatment;
  • you are responsible for your own health decisions; and
  • you should seek professional medical care for diagnosis, treatment, emergencies, or concerns requiring clinical judgment.

If you believe you may be experiencing a medical emergency, call emergency services or contact a licensed clinician immediately.

5. ACCOUNT REGISTRATION AND ACCOUNT SECURITY

You may be required to create an account to use certain features. You agree to provide accurate information and to keep your login credentials secure.

You are responsible for:

  • all activity that occurs under your account;
  • maintaining the confidentiality of your credentials;
  • promptly informing us if you suspect unauthorized use or access; and
  • ensuring that the information you provide remains accurate and current.

We may require identity, access, or fraud-prevention checks where needed to protect the Services and our users.

6. USER CONTENT AND DATA YOU SUBMIT

You may choose to submit cycle dates, symptoms, health logs, notes, prompts, questions, lifestyle information, and other content through the Services (“User Content”).

You retain ownership of your User Content. By submitting User Content to LunarWise, you grant us the rights necessary to host, process, analyze, display, transmit, and otherwise use that User Content to operate and improve the Services in accordance with our Privacy Policy.

You represent that:

  • you have the right to submit the User Content you provide;
  • your User Content does not violate applicable law or the rights of others; and
  • your User Content is not intentionally false, deceptive, or abusive.

If you upload a lab report or similar health document, you are responsible for ensuring that the document belongs to you or that you have permission to upload it. Automated extraction may be incomplete or inaccurate, and you may be asked to review or confirm extracted information before LunarWise uses it in workflows.

7. ACCEPTABLE USE

You agree not to:

  • use the Services for unlawful, fraudulent, or misleading purposes;
  • attempt to reverse engineer, scrape, or exploit the Services or underlying models except as permitted by law;
  • interfere with, disrupt, or degrade the Services or security protections;
  • submit harmful code, malware, or automated abuse traffic;
  • impersonate another person or misrepresent your identity; or
  • use LunarWise outputs as part of a product or service competing with LunarWise without our written permission.

8. SUBSCRIPTIONS, BILLING, AND TRIALS

Certain features may require a paid subscription or trial. Pricing, billing periods, trial offers, and renewal terms may vary by platform and offer.

If you subscribe through Apple or Google:

  • billing is handled by the applicable app store provider;
  • renewals, cancellation, refunds, and payment management are governed by that provider’s rules; and
  • LunarWise does not directly store your full payment card information.

If you subscribe through another authorized payment provider, the terms of that provider also apply.

You are responsible for reviewing the pricing and renewal terms presented to you before purchase.

9. INTELLECTUAL PROPERTY

The Services, including the app, code, design, branding, visual assets, copy, models, workflows, reports, and other materials made available by LunarWise, are owned by LunarWise or its licensors and are protected by intellectual-property and other applicable laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own internal, personal use.

You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, sublicense, or exploit the Services except as expressly permitted by these Terms or by law.

10. AI-ASSISTED OUTPUTS

Some LunarWise features use artificial intelligence, statistical modeling, or automated pattern analysis. You understand that these outputs may be incomplete, imperfect, probabilistic, or inconsistent.

You agree that:

  • AI-generated or model-assisted content may contain mistakes or omissions;
  • outputs depend in part on the quality and completeness of the information you choose to provide;
  • apparent patterns do not equal a clinical conclusion; and
  • you will independently evaluate any output before acting on it.

AI-assisted lab extraction and lab-related reports may misread, omit, or misclassify information from uploaded documents. LunarWise may use confirmed extracted lab information to support pattern review and doctor-prep workflows, but those outputs are not diagnostic and should be reviewed with a qualified healthcare provider.

11. RESEARCH, ANALYTICS, AND PRODUCT IMPROVEMENT

We may use information generated through operation of the Services for service improvement, analytics, safety, research, and product development as described in the Privacy Policy.

Where permitted by law and described in the Privacy Policy, we may preserve appropriately transformed, pseudonymized, or aggregated information after account deletion for internal research, analytics, and women’s-health product improvement.

12. TERMINATION OR SUSPENSION

You may stop using the Services at any time. We may suspend, restrict, or terminate access if:

  • you violate these Terms;
  • we reasonably suspect fraud, abuse, or security risk;
  • continued access would expose LunarWise or its users to harm or legal risk; or
  • we discontinue a feature or the Services in whole or in part.

Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitation of liability, disputes, and other post-termination obligations.

13. DISCLAIMERS

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW.

LUNARWISE DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

WE DO NOT GUARANTEE THAT FORECASTS, REPORTS, CLUSTERS, AI RESPONSES, OR OTHER OUTPUTS WILL BE ACCURATE, COMPLETE, TIMELY, OR SUITABLE FOR YOUR NEEDS.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNARWISE AND ITS AFFILIATES, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNARWISE’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID TO LUNARWISE FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  • FIFTY U.S. DOLLARS (USD $50).

Nothing in these Terms excludes liability that cannot lawfully be excluded.

15. INDEMNITY

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LunarWise and its affiliates, personnel, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

  • your misuse of the Services;
  • your violation of these Terms;
  • your violation of applicable law; or
  • your infringement of any rights of another person or entity.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your place of residence applies and cannot be displaced by contract.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we will update the effective date and version. Where required by law, we will provide notice of material updates through the app, email, or another appropriate channel.
